Seventh Circuit Vacates Earlier Ruling, Agrees to Re-Hear Appeal En Banc for Landmark Terrorism Financing Case

The U.S. Court of Appeals for the Seventh Circuit has granted a petition for re-hearing, en banc, of the appeal in the Boim terrorism financing case. The decision vacates a previous Seventh Circuit ruling issued in December 2007 in which a three-judge panel vacated the original $156 million judgment and remanded the case back to the lower court.

"We are pleased with the court's decision to grant our petition. Boim vs Quaranic Literacy et al is the first case to articulate the standard by which the Antiterrorism Act passed by Congress in 1993 will be defined. The opinion issued last December by the three-judge panel generated significant confusion as to what standards apply, impacting numerous cases that are pending before courts across our country. The ultimate question before the court is whether individuals and organizations that provide funding to terrorist groups will be held financially responsible for the consequences of terrorist acts."
